Industrial Diseases

Under Section 163 of the Workers' Compensation and Injury Management Act 1981, Industrial Diseases insurance is compulsory for employers engaged in mining. This insurance is provided through the Compensation (Industrial Diseases) Fund.

Liability is limited to workers' compensation payments for the respiratory diseases of:

  • pneumoconiosis,
  • lung cancer, and
  • mesothelioma.

All of which may arise from exposure to harmful mineral dust in the course of employment.

The Act

The Act defines Pneumoconiosis as a disease caused by any process entailing exposure to mineral dusts harmful to the lungs, and includes asbestosis and silicosis.

The Insurance Commission issues industrial diseases insurance policies to the mining industry; and pays claims arising from the policies.

The Compensation (Industrial Diseases) Fund has been in surplus for many years and it is expected that this situation will continue.

Due to its sound financial status, the premium rate was decreased from 1 July 2003 to a flat charge of $110 (including GST) per three-year policy period.

Following a review of the financial performance of the Compensation (Industrial Diseases) Fund and projected future claims in 2005-2006, it was determined to maintain the premium rate at the flat charge of $110 (including GST) per three-year policy period for the next three years (i.e. 2006 - 2009). Brokerage or commission is not paid on these policies.
