Compulsory Third Party

The Compulsory Third Party (CTP) product provides owners and drivers of WA-registered vehicles with liability cover for costs incurred if they cause a crash which results in an injury to another person. The Insurance Commission may pay for your treatment to help you recover if another driver in the accident was at fault and caused your injuries.

We may also be able to pay other expenses, depending on the type and severity of your injury, including:

  • Further treatment, care and support. This may include:
    • Ambulance transport
    • Hospital services
    • Medical services
    • Allied health services
    • Therapy services
    • Dental services
    • X-rays
    • Medical aids
    • Medication
  • Compensation for:
    • Past and future economic loss
    • Pain and suffering.

We pay reasonable and necessary expenses up to the maximum amounts set out in the Australian Medical Association recommended rates for medical services, medical treatment and diagnostic imaging, and up to the WorkCover WA scale of fees for treatments provided by allied health providers. Please check with your treatment provider as there may be a gap payment payable by you.

Economic loss and pain and suffering can only be claimed if you are able to show that another driver was at fault (either fully or in part) for the injuries you suffered as a result of the crash. Claims for economic loss are restricted to a maximum of three times the full-time adult average weekly earnings in Western Australia. We will ask you for information to support your economic loss claim.

Compensation for pain and suffering has to exceed a minimum threshold before any compensation for pain and suffering is payable and it is also capped with a maximum amount payable. The figures for the caps and thresholds are adjusted for inflation each financial year. See the current threshold schedule here.
