Commencing 1 July 2024, the Catastrophic Injury Support (CIS) Scheme will provide treatment, care and support for those catastrophically injured in both motor vehicle accidents and workplace accidents.
Both licensed insurers and self-insurers have notification and information disclosure obligations to the Insurance Commission of Western Australia (ICWA) under the Workers Compensation Injury Management Act 2023 (the Act) in relation to workers compensation injuries and/or claims that are, or appear likely to be, catastrophic.
How to notify the Insurance Commission of Western Australia of a potential Catastrophic Workplace Injury
When you receive notification of a workplace accident where the injury may appear to be catastrophic, email the relevant forms (listed below) to mvcisupport@icwa.wa.gov.au
- Notification of Workers Compensation Claim: Potential Catastrophic Injury
- Notification the injured worker elects to retain the rights to seek damages under Common Law
- Notification the worker is in receipt of payment for damages under Common Law (a settlement)
The CIS Scheme will then determine whether the worker has sustained an eligible injury to be accepted into the scheme. Please refer to Eligibility for the criteria of an eligible injury.
If the reported injury is deemed eligible, the worker will be accepted into the CIS Scheme as an ‘Interim Participant’ for two years.
Towards the end of the two years, the workers’ recovery will be assessed to determine whether they can leave the CIS Scheme as a result of their recovery, or if they are eligible to continue to receive necessary and reasonable treatment, care and support for the rest of their life as a ‘Lifetime Participant’.
